This is an elective subject. This course discusses the role of courts, especially constitutional jurisdictions, in controlling state power; ensure that conflicts between constitutional bodies are resolved peacefully; The lines of demarcation of authority in the constitution are respected and unconstitutional acts will be adjudicated in the judicial way.
The course provides the following knowledge and skills:
(1) Origin and nature of the state; the origin and nature of the constitution and the need to establish constitutional jurisdiction.
(2) History of constitutional jurisdiction in the world and history of constitutional jurisdiction in Vietnam; outline the process of advocacy and development of constitutional jurisdiction.
(3) Knowledge of constitutional jurisdiction, including typical models of constitutional arbitration in the world & constitutional proceedings.
The subject is divided into 12 weeks of study, one session per week, each session is about 04 periods, combining lectures and discussion exercises, spread throughout the year, students will have to practice many skills, divided into groups to discuss. Discuss how to organize the drafting of preliminary outlines, detailed outlines of essays in specialized law subjects.
