5. Course Objectives:

1. Knowledge CLO1.1 Analyze in-depth legal knowledge on various forms of investment within or outside the territory of Vietnam, investment procedures, and the preferential policies and support provided by the State to investors. CLO1.2 Distinguish the scope and forms of investment, as well as applicable restrictions in investment activities between domestic investors and foreign investors. CLO1.3 Evaluate new legal regulations on the purchase, lease, and lease-purchase of future-formed housing, and on the development of social housing and commercial housing in Vietnam, as well as in certain other countries around the world. CLO1.4 Identify differences in housing ownership rights between domestic individuals/organizations and foreign individuals/organizations, or Vietnamese residing overseas. 2. Skills CLO2.1 Design and manage an investment project for investors in full compliance with all legally required contents, conditions, and procedures. CLO2.2 Provide legal consultancy to investors and investment-related state authorities to address complex legal issues arising during the implementation of investment projects and in real estate business activities. CLO2.3 Formulate advanced research questions regarding foreign and Vietnamese legal regulations across different periods in the field of investment and real estate business, serving as a basis for proposing legislative recommendations for Vietnam. CLO2.4 Communicate legal regulations on investment and real estate business clearly and coherently in scientific seminars, dialogues between real estate enterprises and consumers, and meetings with state management agencies. 3. Autonomy and Responsibility CLO3.1. Conduct research and make important decisions as an investor or project-implementing enterprise during project formation, project execution, and real estate business activities. CLO3.2. Facilitate connections and provide orientation for enterprises in carrying out investment projects and conducting real estate business within the legal framework. CLO3.3. Debate the current state of investment and real estate business laws in Vietnam and thereby propose legislative recommendations to improve the legal system. CLO3.4 Uphold responsibility in complying with legal regulations in investment and real estate business activities, meeting all statutory requirements, ensuring customer safety, and respecting customers’ rights in real estate transactions.

6. Brief Description of Course Content:

The subject of Law on Investment and Real Estate Business studies the basic issues:
Firstly, the legal provisions on the rights and obligations of investors, investment forms, investment security, investment dispute settlement, investment incentives and support
Second, study the regulations on investment projects in the form of public-private partnership (PPP), on business cooperation contracts; investment procedures of an investment project; regulations on investment project implementation, as well as regulations related to overseas investment activities of investors in Vietnam.
Third, the legal regulations on real estate business in Vietnam. Students will learn about the concepts and characteristics of real estate business; conditions for real estate business, the scope of investors' real estate business, forms of real estate business (trading in land use rights and trading in houses and construction works); principles applicable to investors in the sale, lease, lease purchase of houses and construction works; State management of the real estate market.
Fourth, legal knowledge on real estate service business such as business conditions, rights and obligations of the parties, principles applied in real estate brokerage, real estate management, floor real estate transactions, real estate consulting, contract regulations applied in the real estate service business in Vietnam.
Fifth, legal knowledge on commercial and social housing development in Vietnam; entities may participate in housing project development, purchase, rent, lease-purchase housing in Vietnam; legal provisions on homeownership for domestic people, overseas Vietnamese and foreigners in the Vietnamese territory.
