5. Course Objectives:

The course Administrative Law and Administrative Litigation provides foundational and advanced knowledge of legal issues in state administrative management and the procedures for resolving administrative disputes. This course aims to equip students with the essential knowledge and skills required for participation in public administrative activities. Specifically, upon completion of the course, students will be able to: Demonstrate a comprehensive understanding of the concepts, roles, and powers of authorities and actors in Administrative Law, as well as the institutional relationships among state administrative bodies. Develop the ability to analyse and apply administrative law in practice, particularly in the fields of public administration, administrative procedures, and administrative decision-making. Enhance research capacity, critical thinking, and evaluative skills in addressing issues of administrative management, thereby proposing solutions to overcome practical limitations. Understand the process of adjudicating administrative cases before the courts, including jurisdiction over the acceptance and resolution of administrative cases; the rights and obligations of participants in administrative proceedings; administrative procedural rules; and the enforcement of court judgments and decisions in administrative cases. Strengthen skills in communication, teamwork, presentation, and the organisation of learning activities within the public service context. Develop autonomy, professional responsibility, and the ability to apply legal knowledge to practical work, while articulating informed viewpoints on issues of administrative law and administrative litigation in Viet Nam.

6. Brief Description of Course Content:

Administrative Law and Administrative Litigation is a specialized legal discipline that provides fundamental knowledge of Administrative Law; state administrative management; administrative violations, the handling of administrative violations; and mechanisms for inspection and supervision of state administrative activities. This body of knowledge is essential for the formulation, organization of implementation, and improvement of administrative law; for ensuring effective administrative management; and for actively safeguarding the lawful rights and interests of individuals and organizations within state administrative management.

In addition, the course Administrative Law and Administrative Litigation covers key issues relating to the jurisdiction of the People’s Courts over administrative adjudication; participants in administrative proceedings; proof, evidence, and interim urgent measures; initiation of lawsuits, acceptance of cases, pre-trial procedures, and first-instance trials; as well as appellate, cassation, and reopening procedures in administrative cases.
